Liability for Geologic Hazards

Abstract

Liability for damage resulting from geologic hazards has its source primarily in the common Previous HitlawNext Hit and secondarily in statutory or constitutional Previous HitlawNext Hit of the federal government or the various states. The range of liability under the common Previous HitlawNext Hit runs from absolute liability through various stages of contingent liability to no liability at all.

Geologic hazards are not uniquely considered in the Previous HitlawNext Hit. Damage from "pure" geologic hazards, those beyond the control and influence of man, should result in no attachment of liability. Where individuals alter the natural environment, some may be found liable for their acts, or failure to act, where there was a duty to take appropriate care to avoid harm and damage occurs.
